Terms of Service

These Terms of Service ("Terms") govern your use of Benefit Guardian (the "Service") at benefitguardian.org and app.benefitguardian.org. By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Description of service

Benefit Guardian is a tool that helps users discover potential benefits from credit cards, paid subscriptions, and government programs. The Service surfaces information that may apply to your situation. You are responsible for verifying and acting on that information yourself.

2. Account registration

To use most features you create an account. You agree to provide accurate information and to keep your login credentials secure. You are responsible for activity under your account. Notify us at support@benefitguardian.org if you believe your account has been compromised.

3. Permitted use

The Service is provided for your personal, non-commercial use. You may not scrape, reverse engineer, decompile, or attempt to extract source code or training data from the Service. You may not resell, sublicense, or redistribute the Service.

4. Prohibited use

You agree not to use the Service to: (a) commit fraud or impersonate another person; (b) submit false information to obtain benefits you are not entitled to; (c) abuse, harass, or threaten others; (d) interfere with or attempt to disrupt the Service; or (e) violate any law or third-party rights.

5. Financial information disclaimer

Card recommendations and benefit estimates surfaced by the Service are informational only and are not financial, investment, tax, or legal advice. Benefit Guardian is not a registered investment adviser, broker-dealer, or fiduciary. You are solely responsible for your financial decisions and should consult a qualified professional before acting on any recommendation.

6. Government program disclaimer

Eligibility information for government programs is informational only. Eligibility rules change and are determined solely by the administering agency. You must verify eligibility with the relevant agency before applying. Benefit Guardian is not affiliated with, endorsed by, or sponsored by any government agency. You are solely responsible for the accuracy of any application you submit; mis-claiming benefits may carry legal consequences that are your responsibility alone.

7. No warranty

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that information surfaced is current or complete.

8. Limitation of liability

To the maximum extent permitted by law, Benefit Guardian's total liability to you for any claim arising from or relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months preceding the claim (which, for a free Service, is zero) or (b) one hundred U.S. dollars (US$100). In no event will Benefit Guardian be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, even if advised of the possibility of such damages.

9. Indemnification

You agree to indemnify and hold harmless Benefit Guardian and its operators from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising from (a) your misuse of the Service, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) any decision you make based on information surfaced by the Service.

10. Intellectual property

Benefit Guardian retains all rights, title, and interest in and to the Service, including its software, design, and content, except for content you submit. You retain ownership of the data you submit. You grant Benefit Guardian a limited, non-exclusive, royalty-free license to use, store, and process that data solely to provide and improve the Service.

11. Account termination

You may delete your account at any time by emailing support@benefitguardian.org. We may suspend or terminate your account if we reasonably believe you have violated these Terms or applicable law. On termination, sections of these Terms that by their nature should survive (including disclaimers, limitations of liability, indemnification, and dispute resolution) will continue to apply.

12. Modifications to the service and to these terms

We may add, change, or remove features at any time. We may also update these Terms from time to time. Material changes will be posted on this page with an updated date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict-of-law principles. The federal and state courts located in New Jersey will have exclusive jurisdiction over any dispute not subject to arbitration under Section 14, except as provided in the small-claims carve-out below.

14. Dispute resolution

Before bringing any formal claim, you agree to attempt to resolve the dispute informally by emailing support@benefitguardian.org with a description of the issue and the relief you seek. If we cannot resolve the dispute within 60 days, either party may proceed to individual binding arbitration administered under generally recognized commercial arbitration rules. You and Benefit Guardian each waive the right to a jury trial and the right to participate in a class action or class arbitration. Notwithstanding the foregoing, either party may bring a claim in small-claims court if the claim qualifies for that court's jurisdiction.
